L’Aguatero processes Personal Information in the European Community. Please note that we operate from within the EU, so the transfer of your personal information to the United States and other parts of the world is not accepted. Your personal information will be processed in accordance with this Estonian and EU Privacy Policy.
The exchange of information
We will share the information we collect, including your Personal Information, as necessary to provide you with the L’Aguatero Service. Hate speech and harassment
We do not allow collections or campaigns that promote or glorify hatred of people based on age, race, ethnicity, national origin, gender, gender identity, sexual orientation, disability, and religion, including hateful people, organizations, or symbols. against these groups. Raising awareness or showing support for victims of violence or human tragedy is allowed, as long as it does not violate any intellectual property rights.
Medical claims
We do not market or allow Merchandise, devices or medical services or medicinal treatments in L’Aguatero. Categories and campaigns that claim to prevent, heal, cure, diagnose, reduce or treat any disease, symptom, dysfunction, malformation or condition are prohibited.
Misleading claims
We do not allow content in any Collection or campaign (image, title, description, or URL) that is false or misleading. This includes misrepresenting your affiliation with any person or entity, misrepresenting the origin of a product's production, or falsely identifying an intended recipient. You may not create collections or run campaigns for charitable organizations without proper authorization from L’Aguatero.
Illegal activity
We do not allow Collection or campaigns that promote any illegal activity. This includes instructions on how to perform illegal acts or encourage other forms of illegal activity. Political speech or discussions about topics or events that are illegal may be acceptable.
Intellectual property
We do not allow Collection or campaigns that infringe the rights of third parties, including the description, title and URL of a campaign, or the text and images that appear on the merchandise created.

Intellectual property: basic concepts
For general understanding
At L’Aguatero, we are very committed to supporting our L’Aguatero creators by helping them produce great custom products and a great experience for their shoppers. In our efforts, we are also committed to protecting the rights of individuals and companies with respect to the content published on the L’Aguatero Service.
Third party rights are based on a variety of laws and legal standards that can be confusing. Those rights are very different from each other and are often misunderstood. We have created this guide to provide very high-level information about certain types of legal rights and to help the creators of L’Aguatero understand what is allowed on the service.
We have described some key rights below (trademark, copyright and right of publicity). In reality, the legal analysis of each of these rights is much more detailed and complex than our summary below. Even so, we hope that the information below is useful and serves as a guide for the creation of Collections and Campaigns in tune with and in accordance with the Policies, Terms and Conditions that regulate the L’Aguatero Service.
Commercial brand
What is a brand?
A trademark is a word, a symbol or a combination of both whose fundamental function is to identify and indicate the "origin of a Product or Service", which means that it allows consumers to identify the company that is ultimately responsible for a particular product, information that the consumer needs to decide who to buy what he wants to buy. It is also intended to inform consumers about the quality and attractiveness of the product itself, so that consumers are more likely to purchase it.

Reputation and brand mean a lot. The value itself is something that companies strive to protect.
What are trademark rights?
The concept behind trademark rights is that the owner of the trademark has the legal right to prevent people from trading on the value of the brand and the reputation of the company. They can do this by stopping the use of any trademarks that are confusingly similar. So, if an unknown car company wants to use the "X" brand to identify its new car, the original owner of the brand will be able to prevent this from being possible based on detectable characteristics and details in the similarity of the brands and the elements that are used to identify. Often trademark owners will also obtain rights to other related products they wish to sell, for example t-shirts.
What does the brand mean for the creators of L’Aguatero?
The creators of L’Aguatero may not use third party trademarks unless expressly authorized. We conduct periodic and random preventive reviews of all Collections and Campaigns to help ensure that third party rights are not violated.
In any case that a design, visual element or Product uses the registered trademark name " L’Aguatero ", which is a registered trademark owned by a legal entity, only this one has the exclusive rights to use " L’Aguatero " in the merchandise.
Like most of the registered trademarks that protects its name and its iconic logo, the Collections or campaigns that do not respect the rights of a registered trademark would be suspended for the unauthorized use of it.
The use of a specific team's colors or shapes has been claimed to infringe that team's trademark when the colors and other design elements indicate, identify, or signal a particular team.
What happens if the logo itself is not used?
As expected, all product, company and institutional logos are clearly protected by trademarks. But legal protection extends far beyond the team’s name and logos.
If a design displays a combination of elements that clearly indicate a particular, then that design is also considered infringing. For example, if a jersey includes a baseball image, a reference to a baseball team, and the colors used by the same team, the trademark owner most likely has an infringement claim.
What is the best test to use?
As described in the previous paragraph, the courts and the conditions of use of a trademark prohibit the use of the different elements of a trademark, even if the exact logo or name is not used. So, the best way to think about when a design is problematic is if the design is intended for fans of a particular product or organization. If you look at a design and know that it is intended for fans of a baseball team, it is very likely that the courts will prohibit the use of that design under trademark law.
Copyright
Copyright protection
Copyrights have been around for hundreds of years. The underlying idea is to give the creators of certain works the right to protect and control the reuse and distribution of that work (whether it is an original, an exact copy, or a modified version).
Copyright law says that a work has to be “original” to be protected. “Original” does not mean innovated, improved or edited. “Original” in the legal sense means that the creator has not copied or reproduced anyone else's work. Under copyright law, no one has the right to use someone else's work as a basis for their own.
The creative must originate your own works, creating them from scratch. For example, in one famous case, a photographer was found to have copied another artist's photograph despite using a different model and location. The details of the second photograph were so similar to the first (the look, layout, and subject matter) that the court found copyright infringement.
Copyright seeks to strike a balance between the freedom to be inspired and the protection of those who create. For example, a fact is not covered by copyright. Utilitarian works, such as instructions or recipes, are not covered. Anyone is free to use ideas, information and references. Copyright only extends to the sole expression of ideas, not to the idea itself.
Copyright is not intended to limit the exchange of ideas and does not cover the underlying idea itself. So, the painter of a landscape cannot prevent other people from painting landscapes. They can only prevent other artists from using your specific painting as a base for other work.
Although copyright does not cover ideas, to the extent that the idea can be expressed in many different ways, each expression will be protected by copyright. But the components of expression, such as individual words and phrases or individual shapes and design elements, are not protected. The expression has to extend beyond the individual components. The simpler the design, the less protection provided by copyright.
What does it mean for the creators of L’Aguatero?
The creators of L’Aguatero may not use copyrighted third-party works unless expressly authorized.
Copyright protects designs as well as written works such as scripts and song lyrics.
The owners of the creative assets used in The Simpsons show control the use of all those assets. This is an example of a copyrighted work that may not be printed without the permission of the copyright holder.
Right of publicity and right of privacy
The right of publicity is very different from the legal rights provided or acquired by trademark and copyright and is a much simpler concept. The right of publicity is the right of famous people to control the commercial use made of their name or image. So, any public or famous person like Madonna or Bill Gates have the right to decide if their names or faces can appear in an advertisement aimed at promoting a certain product.
